“最低价中标”中规避合同风险问题的研究 |

摘要 经评审的最低投标价法已在具有通用技术、一般功能标准的工程项目招标中得到了逐步推广,取得了许多实效,也暴露了一定问题。“最低价中标”中可能出现“低价中标、高价结算”的情况。可通过合同管理中的风险控制和合同签约前的谈判来加以预防,尽量减少工程量变更和索赔给业主带来的损失。 |

Abstract:
The method of the lowest price of tendering has been extended widely in the invitation to tender of projects with the common technique and the general function standard. The effectiveness for a given period is obtained, and also definite problems are exposed.“The low price of tender award and the high price of settlement”can occur in “the lowest price of tender award”. This can be prevented through the risk control in the contract management and negotiation before the contract signature, to reduce the loss of the owner from the changes of the engineering quantities and the claim as far as possible.
